Energy using Products in HungaryMay 26, 2008 Hungary - Design for EnvironmentHungary has implemented the EU Directive on energy-using products (EuPs) through the Governmental Decree No. 217/2007 (VIII.15) on the requirements of eco-design obligations of the energy using products and the general conditions of the placing on the market and conformity assessment of them (the “EuP Decree”). The decree was adopted in July 2007 and entered into force on 14 August 2007.
As the EuP Directive, the EuP Decree establishes a framework for the setting of eco-design requirements for such products. The EuP Decree will be further implemented through implementing measures to be adopted by the Ministry of National Development and Economic Affairs. Energy-using products are not be subject to eco-design or energy efficiency requirements until implementing measures have been issued. The EuP Decree itself does not create legal obligations for manufacturers. Under an implementing measure, manufacturers will be required to perform an assessment of the environmental aspects of their products throughout their life cycle. They will have to use this assessment to evaluate alternative design solutions, with the aim of improving the environmental performance of their products.
Implementing measures will be enforced by several market surveillance authorities. If a product subject to an implementing measure does not comply with the standards imposed by such a measure, possible sanctions that can be imposed include market withdrawal and penalties.
