The Proposed New EC Chemical Law Regime

In February 2001, the Commission issued a White Paper on a future chemicals policy. The White Paper proposed an overhaul and expansion of the EC’s chemical legislation. This new chemical regime would greatly expand the scope of the EC’s current chemical legislation and transform it from a regime predominantly focused on occupational protection into a consumer protection and product safety regime. It would extend the EC chemical law’s scope from chemical substances to products containing chemicals, including electronics, require both laboratory testing and risk assessment, and introduce use-specific registrations and authorizations. Thus, the new regime would have significant implications all EIA member companies. They may be faced with bans or serious restrictions on the marketing and use of chemicals, restrictions on specific uses of chemicals, onerous testing, risk assessment, and reporting obligations, and duties to inform consumers In this special report, the Commission’s key proposals for a new EC chemical policy are discussed.
