Netherlands - Design for Environment, Energy Efficiency

The Netherlands has implemented the EU Directive on energy-using products (EuPs) through the "Act of 27 September 2007 amending the Environmental Management Act, the Act Equipment Energy Savings, and the Act on Economic Offenses" (the "Eco-Design EuP Act"). The act was adopted on 27 September 2007, and published in the Official Journal on 18 October 2007. The Eco-Design EuP Act provides that entry into force is regulated by Royal Decree. A Royal Decree of 9 October 2007 provides that the Eco-Design EuP Act enters into force 19 October 2007. An explanation attached the decree notes that the EuP Directive had to be implemented by 11 August 2007, but that "the delay does have any practical consequences, since no implementing measures have yet been adopted pursuant to the directive."
