Texas TNRCC Determines CRTs are Universal Waste Lamps

We have learned that the Texas Natural Resources Conservation Commission ("TNRCC") issued a letter of opinion on April 30, 2001 to the Lower Colorado River Authority stating that waste cathode ray tubes ("CRTs") may be classified and handled as "universal waste lamps" in Texas. In the letter, TNRCC states that upon review of the arguments set forth by the Lower Colorado River Authority (which had requested the determination), "TNRCC concurs that CRTs are ‘universal waste lamps’ as defined in 40 CFR § 273.5." Texas had earlier incorporated by reference the cited federal universal waste lamp definition. See 30 Tex Admin. Code § 335.261(b)(16)(F).
