The Telecommunications Industry Association ("TIA"), a State of Illinois Non-Profit, 501(c)(6) Corporation, has retained the law firms to develop and maintain this web based regulatory tracking tool (the "Site") for the exclusive use of subscribing companies who have elected to become registered subscribers ("Subscriber") and have paid the applicable subscription fee. Your access to and use of the Service is subject to the following Terms and Conditions ("Terms and Conditions") and all applicable laws. By accessing and browsing the Site and accessing the Service, you accept the Terms and Conditions detailed below and all terms and conditions arising from your subscription contract.

Terms and Conditions

1. Any trademarks or logos (the "Trademarks") displayed on the Site may not be used without the written permission of TIA or such third party that may own the Trademarks. TIA, its contractor and law firms will aggressively enforce their intellectual property rights.

2. Images and information displayed on the Site are either the property of, or used with permission by TIA. Except as otherwise provided in Sections 2.1and 2.2, use of these images by anyone is prohibited. Site material may not be resold or broadcast in any form. Any unauthorized use of the images may violate copyright laws, trademark laws, and communications laws. No copyright is claimed to original government documents.

2.1. Copies, Electronic Transfer.

Subscriber may view and electronically transfer and/or print out information on the Site for Subscriber's company-internal needs.

2.2. Storage of Materials.

Electronically transmitted materials on the Site may be stored on fixed or removable media or in the random access memory of computer systems that are under the direct control of Subscriber and are not shared with, or jointly used by, any person or entity that is not a Subscriber to the EIATRACK Regulatory Tracking Tool.

3. The right to transmit material to the Site or alter the Site is limited to TIA. TIA and its contractors will fully cooperate with any law enforcement authorities requesting TIA to disclose the identity of anyone posting any unlawful or unauthorized information or materials.

4. TIA, its contractors and law firms have not reviewed all sites linked to this Site or all documents posted and are not responsible for the content of sites linked to the Site.

5. THE EIATRACK REGULATORY TRACKING TOOL AND THE REGULATORY TRACKING TOOL MATERIALS ARE PROVIDED ON AN "AS IS," "AS AVAILABLE" BASIS, AND TIA AND ITS ATTORNEYS AND CONTRACTORS EXPRESSLY DISCLAIM ALL WARRANTIES, INCLUDING THE WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. BY ELECTING TO BECOME A REGISTERED SUBSCRIBER, SUBSCRIBER ALSO ACKNOWLEDGES THAT NEITHER TIA NOR ITS ATTORNEYS OR CONTRACTORS ARE PROVIDING ANY REPRESENTATION, WARRANTY, PROMISE, OR GUARANTEE THAT THE REGULATORY TRACKING TOOL IS TRACKING OR PROVIDING NOTICE OF ALL OR ANY ENVIRONMENTAL OR PRODUCT RELATED DEVELOPMENTS THAT MAY AFFECT SUBSCRIBER'S PRODUCTS IN U.S. AND/OR FOREIGN MARKETS, AND SUBSCRIBER ACKNOWLEDGES THAT NEITHER TIA NOR ITS ATTORNEYS AND CONTRACTORS HAVE A DUTY OR RESPONSIBILITY TO UPDATE OR PROVIDE ANY ADDITIONAL INFORMATION TO REFLECT CHANGE OR AMENDMENTS TO INFORMATION SUPPLIED BY THE TIA REGULATORY TRACKING TOOL. TIA, ITS ATTORNEYS AND ITS CONTRACTORS MAKE NO IMPLIED OR EXPRESS WARRANTIES THAT THE REGULATORY TRACKING TOOL WILL BE UNINTERRUPTED OR ERROR FREE. THE REGULATORY TRACKING TOOL MATERIALS ARE PROVIDED FOR INFORMATION AND RESEARCH PURPOSES ONLY AND DO NOT CONSTITUTE LEGAL COUNSEL, AND SHOULD NOT BE USED AS SUCH. ANY RELIANCE ON ANY OF THE TIA REGULATORY TRACKING TOOL MATERIALS SHOULD ONLY BE UNDERTAKEN, IF AT ALL, PURSUANT TO THE ADVICE OF QUALIFIED LEGAL COUNSEL WHO IS AWARE OF SUBSCRIBER'S PARTICULAR CIRCUMSTANCES.

6. IT IS EXPRESSLY AGREED THAT TIA AND ITS CONTRACTORS SHALL HAVE NO LIABILITY WHATSOEVER FOR ANY SPECIAL, INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES OF ANY KIND EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES OCCURRING, AND, BY ELECTING TO BECOME A REGISTERED SUBSCRIBER, SUBSCRIBER AGREES THAT ITS TOTAL DAMAGES ARISING OUT OF OR RELATED TO ITS USE OF THE EIATRACK REGULATORY TRACKING TOOL, SITE MATERIALS, OR USE OF THE INTERNET IN CONNECTION WITH THE REGULATORY TRACKING TOOL AND/OR THE SITE MATERIALS, SHALL BE LIMITED TO THE AMOUNT OF THE SUBSCRIPTION FEE PAID IN CONSIDERATION OF THE CURRENT ONE-YEAR TERM OF THE SUBSCRIPTION. IT IS UNDERSTOOD AND AGREED THAT THE SUBSCRIPTION FEE PAID PURSUANT TO THIS AGREEMENT HAS BEEN SET IN RELIANCE UPON THIS LIMITATION OF LIABILITY.

7. All persons accessing the Site agree that any proceeding arising from the Site shall be governed by the laws of the State of Illinois.
