Introduction
The following Vermont laws restrict the use, sale and distribution, labeling, and disposal of products containing certain toxic substances.
1. Mercury-Specific Legislation
Vermont law bans the sale/distribution and disposal of certain mercury-added products and requires prior written notification and labeling for the sale/distribution of other mercury-added products.
2. Lead-Specific Legislation
Vermont law prohibits the sale of any children’s product containing lead in excess of the specific lead limits.
3. Brominated Flame Retardant Legislation
In 2009, Vermont enacted legislation restricting the use, sale and distribution of certain products containing "penta," "octa," and "deca" bromodiphenyl ethers (penta-, octa- and deca-BDE). The law broadly applies to electronic products containing penta-, octa- and deca-BDEs.
4. Phthalates-Specific Legislation
Beginning in July, 2009, Vermont law bans phthalates in products marketed to children under the age of three.
5. Other Restricted Substances Legislation - Batteries
Vermont law regulates the sale, labeling, and disposal of batteries containing the following:
- lead,
- nickel,
- cadmium, and
- mercury.
