Introduction
On June 16, 2004, Chile published its long-awaited Hazardous Waste Management Regulation (the “Regulation”) which went into effect a year later, on June 16, 2005. The comprehensive regulation is primarily a traditional hazardous waste law, covering waste characterization, generation, storage, transport, manifests, tracking, disposal, incineration, reuse and recycling. The Regulation does not contain more novel concepts such as extended producer responsibility or DfE requirements. Nonetheless, of particular interest to EIATRACK members, the Regulation borrowed from the Basel Convention and classified certain discarded batteries and electrical and electronic components as presumptively hazardous wastes, unless it can be demonstrated that they do not present any hazardous characteristics.
