Introduction

As harmonised by EU requirements, Malta has two different legislative requirements for flame retardants. A third restriction, covering polybrominated biphenyls (PBB) or polybrominated diphenyl ethers (PBDE) in electronics is also not yet transposed (deadline for transposition not until August 13, 2004)

  1. PentaBDE and OctaBDE restriction (applicable to all articles)

  2. TRIS, TEPA and PBB prohibition (applicable to textiles and textile articles)

  3. polybrominated biphenyls (PBB) or polybrominated diphenyl ethers (PBDE) in electronics

    The “Restriction of Use of Hazardous Substances in Electrical and Electronic Equipment Regulation 396/2004” (the “Regulation”), which were published on 31 August 2004 under the Product Safety Act (Act No. V of 2001), transposed the RoHS Directive into Maltese law.

    The RoHS legislation was transposed by the Maltese Standards Authority (MSA) and is to be enforced by the Department of Consumer Affairs.

    The key provisions of the Regulation implementing the RoHS Directive are discussed in this report.
    The chemical restrictions imposed by the law entered into force on 1 July 2006.
