Introduction
The Regulations and Agreements implement, in Norway, Directive 94/62 on Packaging and Packaging Waste, O.J. L 365 (Dec. 31, 1994), in compliance with Norway’s obligations under the EEA. The Regulations and Agreements impose (1) maximum heavy metal concentration levels; (2) take back obligations; (5) recovery and recycling targets; (6) consumer information requirements; and (7) reporting obligations.
The obligations are imposed on “packaging stream agents”. Packaging stream agents are organized in different packaging organizations on the basis of the different types of packaging: (1) brown paper; (2) folded carton; (3) plastic; and (4) metals. Materialretur is the umbrella organization collecting fees on behalf of the material specific joint compliance schemes.
Defined Restrictions: Producers and importers may not place on the Norwegian market packaging containing more than (1) 250 ppm of lead, cadmium, mercury or hexavalent chromium, if placed on the market after June 1999; and (2) 100 ppm of lead, cadmium, mercury or hexavalent chromium, if placed on the market after June 2001.
