Introduction

Chile does not currently have any binding rules targeting restriction of substances in electronic products.  This may well change in the near term.  In recent years, and driven in some measure by Chile’s liberal use of free trade agreements including those with Canada and the U.S. and its bid to join the Organization for Economic Cooperation and Development (OECD), Chile has been actively working towards the development of a comprehensive regulatory framework for restricted substances. 

Under current law, authority over hazardous substances comes from several different laws, decrees and regulations overseen by competing agencies including, among others, CONAMA, the Ministry of Health (MINSAL), the Economy Ministry, the Agricultural Ministry and the Ministry of Transport and Telecommunications.  (See, Annex I of the National Policy for Chemical Security for a detailed list.)  However, to a significant extent, restrictions based on environmental and safety reasons would fall under the authority of MINSAL.
