Introduction
In December 2006, the Ontario Minister of the Environment issued Regulation 542/06 designating batteries as one of several “Municipal Hazardous and Special Wastes” (“MHSW”) that will require waste diversion programs under the Ontario Waste Diversion Act of 2002. The Minister’s Program Request Letter, dated December 12, 2006, calls upon Waste Diversion Ontario (“WDO”) to develop diversion programs for covered MHSW materials through a phased approach: single-use dry cell batteries are covered under Phase I and all other batteries (including rechargeables) are covered under Phase II.
