Introduction
The Regulation imposes (1) essential requirements; (2) maximum heavy metal concentration levels; (3) a marking system; (4) take back obligations on producers, importers and end users; (5) recovery and recycling targets; and (6) reporting requirements on producers, importers and end users.
“All persons responsible for packaging” (defined as any person who has packed products or has them packed in Luxembourg in order to place them on the countries market or at the time when they are placed on the countries’ market or, the importer of the packed products who does not consume the himself) shall be subject to a take-back obligation either individually or through an approved organization. Users of packaging, including consumers, are required to use take-back systems, including in particular selective collection, for packaging and packaging waste managed by public legal entities or by private legal persons. Defined Restrictions: Producers and importers may not place on the market packaging containing:
- more than 250 ppm of lead, cadmium, mercury or hexavalent chromium, if placed on the market after 30 June 1999.
- more than 100 ppm of lead, cadmium, mercury or hexavalent chromium, if placed on the market after 30 June 2001.
The heavy metals content limits do not apply to packaging made entirely of lead crystal glass.
