Introduction

Estonia has implemented the WEEE and the RoHS Directives through several legal instruments, including (i) Amendments to the Waste Act of 1 May 2004, (ii) Regulation of Government No. 376 adopted 24 December 2004, (iii) Regulation of Government No 28 of 30 January 2006, (iv) Regulation of Minister of Environment No. 9 of 9 February 2005 ans (v) Regulation of Government No 154 adopted on 6 July 2006 . The first four laws have entered into effect on 13 August 2005.  The RoHS Directive was transposed through amendments to the Waste Act and the Regulation of Government No 154 of 2006 on restricted hazardous substances and exemptions.

Estonia has been granted a derogation of two years for meeting the collection, recovery and reuse/recycling targets. The applicable deadline is 31 December 2008. Producers' obligations to take back WEEE have been in effect since 13 August 2005.

Producers are required to register with the Environment Information Centre (EEIC), a division of the Environment Ministry. Producers already on the market were required to register by 20 February 2006. Producers are responsible for organizing separate collection and treatment systems for their WEEE. Producers must ensure that EEE put on the market after 13 August 2005 will be separately collected and managed in accordance with the law. Producers are responsible for the waste management of WEEE. Membership of a producer in a compliance organization will serve as a guarantee to ensure the financing of the proper disposal of electrical and electronic equipment (EEE).

Two collective schemes have been established: "EES-Ringlus MTU" and "Elektroonikaromu MTU."
