Introduction
Washington enacted comprehensive electronics recycling legislation in 2006. Washington’s electronic waste recycling law requires manufacturers of covered electronic products (“CEPs”) offered for sale in the state to create and finance a system for the collection, transportation, and recycling of unwanted CEPs by January 1, 2009. CEPs may only be offered for sale in the state if product manufacturers are in compliance with the statute’s requirements, which include annual registration, payment of fees, and product labeling. The Washington electronic waste recycling statute and regulations also impose requirements on retailers, collectors, transporters, and direct processors.
Defined Restrictions:
Washington's law defines CEPs to include any of the following items that have been used in Washington state by a covered entity: (1) desktop computers, (2) laptop or portable computers, (3) any monitor with a viewable area greater than four inches measured diagonally, or (4) any video display device having a viewable area of over four inches measured diagonally. Excluded from the CEP definition are medical devices, monitoring and control instruments or systems, motor vehicles, aircraft, certain household appliances, or hand-held portable voice/data devices as defined in 47 U.S.C. §332(d)(1). WAC 173-900-030. Covered entities include households, charities, school districts, small businesses, or small government located in Washington state. Id.
